In a recent court decision a woman who alleged that she had been sexually assaulted by a police officer in Pemberton Township, had her case dismissed for failure to file the necessary notice of claim. In Gilmartin vs Kreig, the plaintiff claimed that she was sexually assaulted following her arrest but she never filed any type of written notice of claim against the officer or the township. The plaintiff claimed that she reported the incident by phone and that her father had also called the Police about the situation. The Court found that a written notice was required and that her failure to provide proper notice was not due to any type of extraordinary circumstances so her claim was dismissed.
